This is an overview of our payment and contractual policies should we both decide it is to our mutual advantage to work together. Your actual contract terms may differ slightly depending on your unique situation.

Deposits, Payment Plans and Payment Methods
Except for specially-negotiated payment terms, 50% of the project estimate is due before work commences. (For small projects or those with a short turnaround, the full fee may be required before work commences. If your project falls into either of these categories, we will confirm this with you.) The remaining balance will be divided into equal monthly payments based on the scope and length of the project. The final invoice will be presented when the final draft documents are delivered, and will include the balance due on the project PLUS reimbursement of any additional expenses (see below).

We accept payment via company check in USD, bank wire transfer in USD, or with a major credit card  (Visa, MasterCard or American Express).

Copyright
The copyright on the content we create on your behalf transfers to you upon receipt of full payment. In the event full payment is not received according to the terms of our agreement, the copyright will be retained until full payment is received. Until then, you are strictly contractually prohibited from using the contents in part or in their entirety.

Payments Due On Receipt
We do not offer terms for payment, e.g. 1% Net 30, Net 10, etc. All payments are due as outlined in our agreement. Your credit card will be billed on the date(s) indicated. If paying by wire transfer or check, payment is due no later than the due date, without exception.

If credit card payments are declined or payment is not received according to our Agreement, all work will cease immediately until payment is current. If more than 15 days pass after the due date without receipt of payment, your project will be permanently archived. To reinstate your project, the entire contract amount must be paid in full before additional work commences to continue and subsequently complete your project.

Timely Communication
The success of your project is dependent on open and ongoing communication. Our Agreement includes language specifying the need to receive an acknowledgement of emails sent to you and timely response of no more than 5 days for revisions (or communication of an estimated completion date). If communications unexpectedly cease for more than 10 days after emailing requests to you, your project will be permanently archived with no refunds of amounts paid.

Project-related Expenses
Clients are responsible for all project-related expenses including, but not limited to: travel expenses (airfare, hotel, transportation and meals while traveling), travel time including local travel over one hour daily, supplies, postage and shipping, telephone calls outside the US and Canada and photocopies. Expenses are due as incurred, unless we agree to other arrangements in advance.

'Spec' Work
We do not write books or articles "on spec" (in anticipation of you selling the work to a publisher at a future date). Nor do we discount our work on your promise of future work. We work strictly on a services-performed basis; when services have been delivered according to our agreement, full payment is due, not when/if your book or article is published.

Acting as Literary Agent/Selling your Book
Although we do not provide these services, we can provide industry recommendations with confidence.

Warranties/Guarantees
Our guarantee is to use our writing and business expertise to the very best of our ability to ensure clients are fully satisfied with the written works we produce.

Beyond that, we do not warranty or guarantee the written work(s) we create will produce specific results the client may seek, including but not limited to the client being able to sell a book manuscript or idea to a publisher, or any desired impact on client's sales, revenue, Web site traffic or professional reputation. There are simply too many factors outside of our direct control, including the possibility that the client may alter documents after final delivery. Therefore, we accept no responsibility for results the client may or may not achieve based on the written works created on a client's behalf.

Non-disclosure/Confidentiality
We take confidentiality, and your privacy, very seriously. In our signed contract, you have our assurance of confidentiality. We will not knowingly disclose your information or anything about our relationship unless you have given us express permission to do so, or unless required by law. This includes situations in which there is the possibility of us writing on topics similar to your project or if we accept work from one of your competitors.

As your ghostwriter, we will ask your permission to list you as a reference or to add your book/article to our portfolio. If you prefer to maintain complete anonymity, we respect that and will not reference your work in our marketing content.

Non-compete Agreements
We do not enter into non-compete agreements. Contracts should be fair, equitable and appealing to both parties. In our experience, NCAs are financially harmful to freelance writers. As such, they do not create 'win-win' circumstances for both parties. Furthermore they are either illegal or non-enforcable in many states because potentially they serve to significantly restrict the writer's ability to earn a living within their industry and/or geographic area. If you are concerned about protecting your proprietary methods, and personal or company information, the non-disclosure agreement we include in our contracts should be more than sufficient to protect your interests.
